Etter Edition, referred to as EE, is governed by Swiss law. We will not disclose your personal information to a third party without your consent unless we are required or authorised to do so by law or other regulations. We are not liable for any loss due to inaccuracies or incompleteness, nor for loss resulting from problems caused by or inherent to disseminating information through the internet for any kind of art sold or featured via the EE website. For any loss suffered as a result of the use of data, advice or ideas provided by or on behalf of EE via its website, EE accepts no liability. By shopping via or visiting website or the website related, this Legal statement is considered accepted by all users.
Customer's obligations to inspect and notify
You are obliged to inspect the Artwork for functionality, completeness and potential transport damage immediately after receipt.
You must notify us in writing of any recognizable defect or damage immediately after discovery but at the latest 10 days after receipt of the Artwork. Any hidden defects must be notified to us in writing immediately after their discovery. If you fail to notify us of any defect or damage within these time-limits, the Artwork is deemed approved and any claims relating to defects and warranty are excluded.
If there is a defect, you must retain the Artwork in the condition in which it was delivered to you and must not use it further.
We may request you to return the Artwork to our premises at your own expense. If your complaint is justified, we will reimburse the transport costs based on the most cost-efficient transport route. If your complaint is unjustified, we will be entitled to be reimbursed for any costs incurred.
Warranty
We warrant for a period of 1 year from the time of delivery (transfer of risk) that the Artwork will be free from defects and fully functional. If there is a defect eligible for warranty, we may, at our sole discretion, either:
repair the Artwork in Zurich; or
provide a new Artwork running the same verified code
The client is responsible for the shipping or delivery of the Art Work to the artist’s studio in Zurich, Switzerland.
Any other or further-reaching warranty rights as well as the statutory provisions for warranty are excluded.
The warranty rights set out above cannot be transferred or assigned to any third party, including any future buyer of the Artwork.
Upon expiry of one year after delivery (transfer of risk) of the Artwork, any claims for warranty will be time-barred.
Shipping
All the shipping costs of physical goods are calculated and billed separately. Please contact us for the best quote. Worldwide shipping available upon request.
Exclusion of liability
Liability for slight negligence on our part is excluded. Liability for any acts or omissions of our auxiliary persons is excluded. In any case, our liability is limited at a maximum amount corresponding to the invoice amount.
Partial invalidity
If any individual terms of these Terms should be invalid or void, the validity of the other provisions of these Terms are not affected.
Applicable law and place of jurisdiction
All legal relations between you and us are exclusively governed by substantive Swiss law, excluding the conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is 8005 Zurich/Switzerland.
